1. Renter agrees to rent one available studio space at the agreed upon rate for the dates and times specified in this contract. 2. Renter is responsible for full payment prior to use of the space. 3. The premises must be left in the condition in which they were found at the beginning of the rental period and will be subject to approval by the Druid Hills Dance Center owner. This includes damage to the walls, floors, fixtures, stereo, and general facility space. Damage to the space caused by the renter or those attending the renter’s event must be repaired at full cost to the renter. 4. Street shoes are not allowed on the marley dance floor in Studio A, but may be used on the wood dance floor in Studio B. 5. Alcoholic beverages, candles, smoking, or smoking devices are not permitted in the studio. 6. The conduct of all participants and spectators while at the Druid Hills Dance Center shall be the responsibility of the Renter. Renter also accepts all responsibility for any injury to person(s) or property, or loss of or damage to property or theft of personal property at the Druid Hills Dance Center during the rental period, or resulting therefrom. The Druid Hills Dance Center retains the right to evict objectionable persons from the premises or to call for security/police help if deemed necessary. 7. Renters shall release, indemnify, keep and save harmless the Druid Hills Dance Center its agents, officers, employees, or members from any and all responsibility or liability for any and all damages or injury of any kind or nature whatever (including death) to all persons, whether agents or employees of the Renter or persons attending the events for which the premises have been leased, and to all property damage proximately caused by, incident to, resulting from, arising out of, occurring in connection with, the use by the Renter of the premises. The provisions of this section shall include any and all losses, damages, injuries, settlements, judgments, decrees, awards, fines, penalties, claims, costs and expenses, including reasonable attorney‘s fees. Druid Hills Dance Center assumes no responsibility or liability for any injuries or damages that occur during this rental period. 8. The renter agrees to provide their own liability insurance for their event. 9. The renter will comply with maximum occupancy rules of the studio. COVID-19 WAIVER I understand and agree to the following conditions of entering the studio space at the Druid Hills Dance Center: • No person (dancer, faculty, or staff) diagnosed with COVID-19, exhibiting symptoms of COVID-19, or having contact with a person that has or is suspected to have COVID-19 within the past fourteen (14) days will be allowed to attend classes or enter the space at theDruid Hills Dance Center. • Temperatures of all persons taking classes (dancers, faculty, and staff) will be taken upon arrival with a touchless thermometer. Persons using the space outside of regular classes should take their own temperature prior to arrival. Any person exhibiting a temperature greater than 100.4 degrees Fahrenheit, cough, shortness of breath, difficulty breathing, other respiratory symptoms, or at least two of the following symptoms: chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell will not be allowed to attend classes or enter the space at the Druid Hills Dance Center. • Any person (dancer, faculty, or staff member) exhibiting a temperature greater than 100.4 degrees Fahrenheit, cough, shortness of breath, difficulty breathing, other respiratory symptoms, or at least two of the following symptoms: chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell will be separated from the group immediately and must leave the Druid Hills Dance Center as soon as practicable. • Any person (dancer, faculty, or staff member) that has stayed home sick or been prevented from attending DHDC classes due to signs of illness, or been sent home from DHDC due to signs of illness shall not be permitted back to class or to enter the space until they have either had a negative COVID-19 test or have been fever and fever mediation free for seventytwo (72) hours, other symptoms have improved, and at least ten (10) days have passed since symptoms first appeared. • All persons entering the Druid Hills Dance Center will adhere to the signage, social distancing markers, and safety rules given by instructors and owner while at the Druid Hills Dance Center. I understand and fully agree to the COVID-19 safety rules and acknowledge that I have not tested positive, shown symptoms, or come in contact with someone who has tested positive or shown symptoms of COVID-19. WAIVER OF LIABILITY By registering at the Druid Hills Dance Center or using the studio space, I agree to the following. As a Participant in any program or class associated in any way with the Druid Hills Dance Center or use of the space at the Druid Hills Dance Center I acknowledge and recognize that there are certain inherent risks of physical injury or illness, AND I HEREBY AGREE TO ASSUME THE FULL RISK of injury or illness, including death, damages or other loss that I, my minor child, or my group’s participants may sustain as a result of participation in any activities connected or associated with such programs or classes or use of the space. I FURTHER AGREE TO WAIVE AND RELINQUISH ALL CLAIMS I, my minor child, or my group’s participants may have as a result of participating in any programs or classes or use of the space against Druid Hills Dance Center, and its owners, agents, servants, representatives, employees, independent contractors, officers, managers, successors or assigns. I FURTHER AGREE TO INDEMNIFY AND HOLD HARMLESS and defend Druid Hills Dance Center, and its owners, agents, servants, representatives, employees, independent contractors, officers, managers, successors or assigns, from my claims resulting from injury or illness, including death, damages or other loss that I, my minor child, or my group’s participants may sustain as a result of participation in any activities connected or associated with such programs or classes or use of the space. I HAVE READ AND FULLY UNDERSTAND THE ABOVE WAIVER AND RELEASE OF ALL CLAIMS. Damages to the Studio Space By entering or using the space at the Druid Hills Dance Center, I accept full responsibility for any loss or damages that result to the space or property of the Druid Hills Dance Center by myself, my minor child, or my group participants while we are using the space. I will assume the full cost to replace or repair any damages myself or my group causes to the Druid Hills Dance Center. I will adhere and enforce to my group participants the DHDC space rules for appropriate use of the space. I HAVE READ AND FULLY UNDERSTAND AND AGREE TO THE ABOVE. AUTOPAYMENT CONSENT You card on file will be automatically charged on the 1st of the month following your rental date.
